About Divorce & Legal Separation

Use the forms and instructions in this section to learn how to:

  • Get a divorce or legal separation
  • Convert A legal separation to a divorce, and
  • How to respond if you receive paperwork related to a divorce.

Name Restoration

Either spouse can request that the Court restore their prior full name to what it was before the marriage or civil union in the Petition (JDF 1011) or Response (JDF 1015). 

Or:

  • File JDF 1824 - Motion for Name Restoration in the court where the decree was entered.  And
  • File JDF 1825 - Order. (caption only)

Filing Fee

  • There is no filing fee if you file for a name restoration within 60 days after the decree has been signed.

Optional Court Hearing

You can ask the court to issue your decree without having to appear in court. The decision will be up to the court on whether or not you have to appear.  

To make that request, file:

  • JDF 1018 - Affidavit for Decree Without Appearance.

 

Flexible Caption

A Flexible Caption has been created for those documents where it is necessary to have flexibility in the caption to include all required information (e.g., a civil filing with fifty Plaintiffs versus fifty Defendants), or for parties who need to prepare their own documents when forms are not available.
