About Toll Ticket Appeals

A toll ticket appeal asks the court to look at the decision made by a hearing officer related to a ticket received for toll evasion on a toll road. You must have gone through a hearing with the E-470 Public Highway Authority or Colorado High Performance Transportation Enterprise (HTPE) before starting a toll ticket appeal with the county court.

A toll road is usually a highway or road that is maintained (repaired, plowed, etc.) by a private company, not the state, county, or city.

How to Start a Toll Ticket Appeal

Start your toll ticket appeal in the county court of the county where you received your toll ticket. Use the courts locator to find the address of the court.

E-470 toll tickets are given in Adams County, Arapahoe County, or Douglas County. If you received your ticket in Arapahoe County, the Littleton location handles toll ticket appeals.

HTPE toll tickets are given in a variety of counties across Colorado.

You have 30 days from the date that the E-470 Public Highway Authority or Colorado High Performance Transportation Enterprise (HTPE) issues an order, or 30 days from the date of your hearing with the E-470 Public Highway Authority or HTPE, to give your toll ticket appeal paperwork to the county court.

For E-470 toll tickets:

  • Download and fill out JDF 234 - Complaint for Judicial Review Pursuant to C.R.S. §43-4-506.5(4)(f).
  • In addition to the form, a certified copy of the Hearing Officer's final order must be filed with the complaint.

For HTPE toll tickets:

  • Download and fill out JDF 233 - Complaint for Judicial Review Pursuant to C.R.S. §43-4-808(2)(d)(VI).
  • In addition to the form, a certified copy of the Hearing Officer's final order must be filed with the complaint.

  • You are the Defendant/Appellant.
  • Follow the prompts on the form to fill in the blanks on the Complaint.

How to Submit Paperwork to the Court

  1. Decide where (which courthouse) to deliver your paperwork. You will need to know in which county you received your toll ticket. Deliver your paperwork to the county court in the county where you received your toll ticket. Use the courts locator to find the address of the court. If you received your ticket in Arapahoe County, the Littleton location handles E-470 toll ticket appeals.
  2. Give the court the completed form.
  3. Pay the filing fee. If you do not think you can afford the filing fee, fill out form JDF 205 Motion to File Without Payment and Supporting Financial Affidavit and JDF 206 Finding and Order Concerning Payment of Fees to request a waiver of the filing fee, or visit our File Without Payment section for complete information.
  4. The court shall issue a civil summons. The court will issue form CRCCP 1 to be served along with the complaint.
  5. Serve the paperwork on the appropriate parties. After you file your forms with the court, you must arrange to deliver your complaint and summons on the appropriate authority. The process of having these forms delivered to the other party is known as personal service. The clerk will provide you with a signed copy of CRCCP 1 Summons to be served. Refer to the step-by-step instructions on how to arrange for personal service and how to return proof of service to the court.
    • For E-470 toll tickets, you will serve JDF 234 and CRCCP 1 on the E-470 Public Highway Authority.
    • For HPTE toll tickets, you will serve JDF 233 and CRCCP 1 on the Colorado High Performance Transportation Enterprise and the Attorney General's Office.

After Paperwork Is Filed

The county court judge will look at the paperwork in your toll ticket appeal, including any records from the E-470 or HPTE case. A hearing will be scheduled within 120 days where you may give evidence or subpoena witnesses.  

The county court judge will create a written ruling or order, and you will receive a copy of the written ruling or order.
