Landlords most follow the right process when evicting a tenant. If not followed, the tenant can file a lawsuit. If the tenant wins:

  • The court can award the tenant money (damages).
  • A district court can stop the unlawful eviction while the case is pending (injunction).

Forms and Paperwork Required

Use the forms link above to download and complete the Unlawful Evictions forms according to the following step-by-step process:

1. Tenant Starts a Case

  • Complaint (no form available)
  • JDF 601 Cover Sheet (district court only)
  • Form 1 Summons (county court)
  • JDF 600 Summons (district court)

2. Tenant Serves the Landlord

3. Landlord Responds

  • Form 3 Answer Under Simplified Civil Procedure (county court)
    • Due within 14 days.
  • JDF 81 Response (district court)
    • Due within 21 days.

4. For the Hearing
